Documents (family member of a EU citizen registration)
What documents need to be submitted when registering in the immigration register as a relative of a subject of the EU, EEA or Switzerland (and who is himself/herself not a subject of the EU, EEA or Switzerland)?
In addition to the national passport, the person in question will have to submit other documents depending on his/her category:
Holders of a national passport with visa D (settlement visa) for family reunification
Usually the necessary documents have already been submitted to the Belgian Consulate in the country of origin. Consequently the person in question, as a function of his/her personal situation of family reunification, must only submit a birth certificate or a certificate of marriage (depending on the circumstances a translated, legalised, with marginal note (apostille)) with his/her registration in the immigration register.
Holders of a national passport with visa C (tourist visa) or people without a visa
Spouse of a subject of the EU, EEA or Switzerland
Depending on the circumstances a translated, legalised certificate of marriage with a marginal note (apostille). Remark: it must be an original from the country where the marriage was performed, i.e. not a transcription.
Please note: the spouse of a Belgian subject must also submit other documents in addition to the certificate of marriage: deed of property or registered lease contract + proof of income of the other person + insurance for medical care in Belgium.
Partner of a subject of the EU, EEA or Switzerland in the context of a commitment that is the equivalent to marriage
Registered partnership that is the equivalent to marriage (the document must be translated with an enclosed marginal note (apostille) depending on the circumstances).
This only concerns partnerships registered in Germany, Denmark, Finland, Iceland, Norway, the United Kingdom and Sweden. If the other person is Belgian, the partner must submit the same additional documents as the spouse of a Belgian subject.
Partner of a subject of the EU, EEA or Switzerland in the context of a long-term relationship
If the person in question is already bound by a legally registered foreign partnership (e.g.: French PACS, registered partnership in the Netherlands, in Luxembourg,…), the document confirming the registration of the partnership must be submitted. If this is not the case, he/she and his/her partner must have a statement of legal cohabitation registered by the Marriages and legal cohabitation department.
Regardless of the kind of registered partnership (legal cohabitation, French PACS,…) he/she must also provide proof of a long-term relationship (proof that shows the partners have known each other for at least 2 years or that they have been living together for at least 1 year or that they have a child together in which case the birth certificate of the child is required).
If the other person is Belgian, the partner must submit the same additional documents as the spouse of a Belgian subject.
Descendant of a subject of the EU, EEA or Switzerland
Birth certificate with descent (translated, legalised and with a marginal note (apostille), depending on the circumstances) + guardianship /custody or parental consent (for the minor). If the descendant is 21 or older, he/she must also provide proof of the income of the guarantor + proof of acceptance of the costs by the guarantor.
If the other parent is Belgian, the person in question must submit a deed of property or registered lease contract + proof of income of the other person + insurance for medical care in Belgium.
Parent (father or mother) of a Belgian minor
Birth certificate with descent (translated, legalised and with a marginal note (apostille), depending on the circumstances) of the Belgian child + proof of financial and/or emotional ties if the person in question does not live with the child (e.g. proof of payment of maintenance,…)
Ascendant of an of age subject of the EU, EEA or Switzerland
Repetition: it is no longer possible to register an ascendant of an of age Belgian!
Birth certificate (translated, legalised and with a marginal note (apostille), depending on the circumstances) of the other person (= son or daughter of the person in question) + proof of income of the guarantor + proof of acceptance of the cost by the guarantor.
