Legal cohabitation - registration

The declaration of legal cohabitation is a legal device by which you and your cohabitant can make your cohabitation official before the Civil Registrar of your commune of residence.

  • Be 18 years old and have legal capacity
  • Not be married or in legal cohabitation with another person

The Civil Registrar shall refuse to record the declaration of legal cohabitation if he/she finds that the intention of at least one of the parties is to obtain an advantage in terms of residence or if the declaration of legal cohabitation is entered into without the consent of at least one of the legal cohabitants or if consent has been given under violence or threat.

The Civil Registrar may also postpone recording the declaration of legal cohabitation in order to carry out a further investigation.

If the two future legal cohabitants are Belgian, born in Belgium, with no previous civil status abroad, the identity card is sufficient for the registration of the legal cohabitation. You can make an appointment directly at the counter of the Administrative Centre of the City of Brussels:

The registration must take place at the counter, in the presence of both partners.

In other cases, the service will first provide all the personalised information. The list of documents to be provided varies according to the particular situation of the future spouses (nationality, civil status, residence status,...).

Two steps are necessary:

  1. Make a telephone appointment to request the information
  2. You can then make an appointment at the counter of the Administrative Centre of the City of Brussels:

  • Identity card or residence permit and/or passport.
  • The other documents that were filled in during the telephone appointment.

Please note that if foreign documents are required:

  • all documents must be original
  • if not in French or Dutch, all documents must be translated into these languages by a sworn translator
  • some documents must be apostilled/legalised
